Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and charter brokerage services of Soarin Aviation, LLC ("Soarin," "we," "us"). By using our services you agree to these Terms.

1. Air Charter Broker Status

Soarin Aviation, LLC is an air charter broker as defined by the United States Department of Transportation. Soarin is not a direct or indirect "air carrier" and does not own, operate, or maintain operational control of any aircraft. All flights arranged by Soarin are operated by FAA Part 135 (or foreign equivalent) certificated air carriers, who at all times maintain full operational control of the flight. As required by 14 C.F.R. Part 295, the name of the operating air carrier and FAA-issued operating certificate number, the aircraft's registration ("tail") number, and the basis of liability and insurance disclosures will be provided in writing prior to each flight.

2. Quotes and Booking

Quotes are estimates based on operator pricing at the time of issue and remain subject to aircraft and crew availability. A binding agreement is formed only when a charter agreement is signed and any required deposit is received. Quoted pricing may be adjusted for fuel, taxes, fees, slots, de-icing, and other costs documented in the charter agreement.

3. Cancellation

Cancellation, postponement, and refund terms are set by the operating air carrier and are stated in your charter agreement. Soarin's brokerage fee is generally non-refundable once the trip has been sourced and confirmed.

4. Passenger Conduct & Compliance

Passengers must comply with all applicable aviation, customs, immigration, and security regulations. The operating carrier and pilot in command have sole authority to refuse carriage where safety or law requires.

5. Limitation of Liability

To the maximum extent permitted by California law, Soarin's liability arising out of or in connection with the brokerage services is limited to the amount of brokerage fees actually paid by you for the affected trip. Soarin is not liable for the acts or omissions of operating air carriers or other third parties. Nothing in these Terms limits liability that cannot be excluded by law.

6. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Orange County, California.

7. Changes

We may update these Terms from time to time; the current version is always posted on this page.
